IMBESTIGASYON SA ‘GENTLEMAN’S AGREEMENT’ SA WPS, SINIMULAN NG MAGKASANIB NA KOMITE



Sinimulan ngayong Lunes ng magkasanib na Komite ng National Defense and Security, na pinangungunahan ni vice chairman Iloilo Rep. Raul Tupas, at ng Espesyal na Komite sa West Philippine Sea na pinamumunuan ni Mandaluyong City Rep. Neptali Gonzales II, ang kanilang imbestigasyon sa umano'y "gentleman's agreement" sa pagitan ni dating Pangulong Rodrigo Duterte at Chinese President Xi Jinping sa West Philippine Sea (WPS). 


“We need to ferret out the truth to clarify the confusion that is happening now,” ani Tupas, matapos na patuloy na ipinagpipilitan ng embahada ng China ang umano'y ‘gentlemen’s agreement’ para bigyang katuwiran ang ginagawang aksyon ng China sa mga misyon sa pagsusuplay sa mga kawal na nakatalaga sa Ayungin Shoal. 


Binigyang-diin ni Gonzales ang iligalidad ng umano'y kasunduan, “I have asserted that the so-called agreement is constitutionally void and is therefore non-binding. It is also worth repeating that the Ayungin Shoal is well within our exclusive economic zone (EEZ). This simply means we have all the right to maintain and resupply our outpost in Ayungin, the BRP Sierra Madre, regardless of whatever some might say on the contrary. The Filipino people must not fall prey to the narrative that it is our government which is causing the rising tension in the WPS when we are only protecting what is clearly ours to protect.” 


Ang imbestigasyon ay isinasagawa alinsunod sa House Resolution 1684 na inihain ni Zambales Rep. Jefferson Khonghun, at sa privilege speech sa plenaryo noong ika-30 ng Abril 2024 ni 1-Rider Party-list Rep. Ramon Rodrigo Gutierrez, hinggil sa umano'y "gentleman's agreement." 


Inimbita ng Kamara ang mga pangunahing opisyal ng administrasyong Duterte sa pagdinig ngunit walang dumalo. Nagpadala naman ng kinatawan si dating Executive Secretary Salvador Medialdea, at liham sa magkasanib na lupon, at ipinaliwanag na may nauna na siyang dadaluhang pulong. 


Hindi rin nakadalo nina dating Defense Secretary Delfin Lorenzana at dating National Security Adviser Hermogenes Esperon Jr. Ayon kay Surigao del Sur Rep. Johnny Pimentel, kung kinakailangan ay maaaring gamitn ng magkasanib na kupon ang kanilang kapangyarihan sa ilalim ng Konstitusyon, upang sapilitang padaluhin ang mga opisyal ng dating administrasyon sa imbestigasyon. 


Gayundin, sinabi ni Antipolo City Rep. Romeo Acop na isinasaad sa House protocol na kung ang paliwanag sa hindi pagdalo ng isang resource person ay hindi katanggap-tanggap sa chairman at mga miyembro ng Komite, o kung hindi nakapagbigay ng malinaw na dahilan sa hindi pagdalo, ay kasunod nito ang  pagpapalabas ng show cause order bilang bahagi ng protocol. 


Ayon kay Department of Foreign Affairs (DFA) Assistant Secretary Aileen Mendiola-Rau,  walang nakatala sa DFA ng “gentleman’s agreement” na binabanggit ng Chinese Embassy. 


“The DFA reiterates its firm position that the Philippines has not entered into any agreement abandoning its sovereign rights and jurisdiction over its EEZ and continental shelf, including on the Ayungin Shoal. On issues of such importance, any agreement or arrangement would be made only if authorized by the highest level of government. 


Only the President of the Republic of the Philippines can approve or authorize agreements entered into by the Philippine government on matters pertaining to the WPS and the South China Sea,” ani Rau. 


Ipinahayag ni Department of National Defense (DND) Undersecretary Ignacio Madriaga ang ganap na panghihinayang ng ahensya, dahil sa kasalukuyan ay hindi makapagbahagi ang DND sa magkasanib na lupon ng sapat na unawa, o ganap na paliwanag sa usapin, dahil hindi naman aniya alam ang  hinggil sa “gentleman’s agreement” sa China. 


“We do not have any record in our possession detailing or potentially showing contours of a deal. This issue, if allowed to continue, is providing opportunity for China to utilize our democratic institutions and processes to propagate its illegal and deceptive narratives designed to undermine the faith and support of the people in our government,” ayon kay Madriaga. 


Sinabi ni Department of Justice (DOJ) Senior State Counsel Atty. Fretti Ganchoon na walang nakitang anumang kasunduan ang DOJ at nilalaman nito, at idinagdag na, “In any case, this agreement has been rescinded already by the President himself last August 9, 2023, and this agreement … does not in any way bind the Philippines.” 


Umaasa si incumbent National Security Council Deputy Director General Nestor Herico sa press statement na inilathala noong ika-11 ng Abril 2024 sa website ng Philippine News Agency, na nagsasaad na pinabubulaanan ni dating Pangulong Duterte ang “gentleman’s agreement.” 


Sinabi ni dating Philippine Coast Guard (PCG) Commandant Joel Garcia na mula noong 2016 hanggang 2022 ay hindi nakarinig ang PCG ng anumang “gentlemen’s agreement” sa pagitan ni dating Pangulong Duterte at China. “Otherwise, it could have been cascaded down to us as the forefront agency, in our quest towards protecting our sovereignty and sovereign rights in the South China Sea and WPS.,” ani Garcia.


Muling ipagpapatuloy ng magkasanib na lupon ang imbestigasyon bukas, Martes.
