PANUKALANG MAGDARAGDAG NG 5-ARAW NA PAID SERVICE INCENTIVE LEAVE SA 10, APRUBADO SA KAPULUNGAN

Sa nagkakaisang boto na 273, inaprubahan ng Kapulungan ng mga Kinatawan ngayong Martes sa ikatlo at huling pagbasa ang panukala, na naglalayong dagdagan at gawing 10 araw ang mandatoryong five-day service incentive leave para sa mga kwalipikadong kawani sa ilalim ng Labor Code.

 

Layon ng House Bill (HB) No. 988 na amyendahan ang Article 95, na inamyendahan, ang Presidential Decree No. 442, o ang Labor Code of the Philippines, upang partikular na  dagdagan ang service incentive leave na may bayad, na ibibigay sa bawat kawani na nakapagsilbi na ng isang taon.

 

Sa ilalim ng kasalukuyang ika-19 na Kongreso, ang panukala ay iniakda nina Speaker Martin G. Romualdez, House Majority Leader Manuel Jose "Mannix" M. Dalipe, Representatives Mark Go, Luis Raymund Villafuerte, Miguel Luis Villafuerte, Tsuyoshi Horibata, Nicolas Enciso, Juan Fidel Nograles, Mary Mitzi Cajayon-Uy, Charisse Anne Hernandez, Keith Micah Tan, Allan Ty, Christopherson Yap, Munir Arbison Jr., Arlene Brosas, France Castro, Christopher de Venecia, Paolo Duterte, Edcel Lagman, Romeo Acop, Bonifacio Bosita, Carl Cari, Edwin Gardiola, Gerville Luistro, Khymer Olaso, Rodolfo Ordanes, Florida Robes, Geraldine Roman, Roman Romulo, Ma. Alana Santos, Jeffrey Soriano, Leody Tarriela, Jocelyn Tulfo, Patrick Vargas, at Loreto Acharon.

 

Tulad ng nakasaad sa orihinal na probisyon, ang service incentive leave ay hindi para sa mga sumusunod: (1) ang mga nakikinabang na sa nasabing benepisyo; (2) ang mga nakikinabang na sa vacation leave na may bayad nang 10 araw; at (3) ang mga kawani ng mga establisimiyento na may mas mababa sa 10 kawani, o mga establisimiyento na may pahintulot na hindi magbigay ng benepisyo ng Secretary of Labor, matapos na maikonsidera ang kakayahan ng pinansyal na kalagayan ng naturang establisimiyento.

 

“At present, our laws do not require employers the granting of sickness and vacation leaves. These work incentives are given based on the prerogative of the employers either by express stipulation on the employee's contract or thru collective bargaining agreement. What the Labor Code provides instead are service incentive leaves (SIL),” ani Go sa explanatory note ng kanyang panukala.

 

“With the increase in the number of leave credits in the form of sick or vacation leaves left purely at the discretion of employers, employees constrained by limited leave credits are left vulnerable to sickness, emergencies, and other fortuitous events that would cost them a day of paid work. The granting of paid leaves is not only beneficial to the employees but economically advantageous for employers as well,” dagdag niya.

 

Sinabi ni Rep. Go na ang naturang insentibo ay, “boost the morale and satisfaction of employees which are manifested in increased productivity, and minimize the risk of health and safety issues among employees, which may even be more costly for both employees and employers in the long run.”

 

Isang kahalintulad na panukala ang inaprubahan ng Kapulungan noong ika-18 Kongreso at naipadala na sa Senado para sa kanilang aksyon at pag-apruba.

                                                                                                                   

Subalit dahil sa kakulangan ng panahon ay hindi ito naisabatas.
