PANUKALA NA TITIYAK SA KALINAWAN AT INDUSTRIYA NG KOMPETISYON SA DATA TRANSMISSION, PASADO

Ipinasa ngayong araw ng Kapulungan ng mga Kinatawan sa ikatlo at huling pagbasa ang isang panukala na magbibigay ng open access at kalinawan sa lumalagong industriya ng data transmission.

Sa pabor na botong 243 at tatlong abstensyon, inaprubahan ang House Bill (HB) No. 6, na kasama sa unang batch ng mga panukala na inihain ni Speaker Martin G. Romualdez sa mga unang araw ng ika-19 na Kongreso. 

"The bill proposes to establish a strong and independent regulatory system and body to create an environment within the data transmission industry that is conducive to open, fair, and innovation-propelled competition, and shall encourage investments in the development of digital infrastructure of the country," ayon kay Romualdez at kanyang mga kapwa may-akda ng panukala.

Ayon sa panukala, ang digital na naghahati sa bansa ay dapat na paliitin, “by encouraging the development of data transmission infrastructure and removing any barrier to competition in data transmission services.”

Isinasaad rito na ang estado ay minandato na, “to require data transmission service providers to adhere to telecommunications standards suitable to the needs and aspirations of the nation and ensure that internet users enjoy the best quality of data transmission service.”

Itinutukoy rito na ang “open access” ay ang “system of allowing the use of data transmission or distribution systems and associated facilities subject to fair, reasonable and non-discriminatory terms in a transparent market.”

Ang salitang “data transmission,” sa kabilang dako ay tumutukoy sa “process of sending digital or digitized analog signal over a communication medium to one or more computing networks, communication or electronic devices.”

Kasama rito ang “provision of Voice over Internet Protocol (VoIP) services but does not include the provision of basic telephone service.”

Ang panukalang batas ay sasaklaw sa kahit sino o isang tao na ang negosyo ay ganap na gumagamit ng transmission ng data, kabilang ang internet service providers, VoIP service supplier at data centers.

Sasakupin rin ito ang mga kompanya ng telekomunikasyon “with respect to the data transmission services they provide and the interconnection to their networks that they extend to data transmission industry participants.”

Isinasaad sa panukala na lahat ng bahagi ng sektor ng data transmission, “shall be competitive and open.”

Ang mga kalahok ay kakailanganing magparehistro sa National Telecommunications Commission (NTC) at sumunod sa mga national at global best practices at pamantayan sa cybersecurity. At ang NTC ang imamandato na tiyakin na ang industriya ng data transmission ay “open and accessible to all qualified participants.”

Titiyakin rin ng NTC at ng Philippine Commission na ang mga kalahok ay susunod sa mga prinsipyo ng kompetisyon sa ilalim ng Philippine Competition Act.

Ang mga manlalaro sa industirya ay kakailanganing mag- “observe fair, reasonable and

non-discriminatory treatment in all their dealings, and that barriers are eliminated to make the industry highly competitive.”

Tinutukoy rin sa panukala ang ilang prohibited acts, kabilang ang pagtanggi ng isang manlalaro sa industriya na magbigay ng akses sa imprastraktura, ang pagtanggap ng kabayaran para may paunahin lamang, at pagpapabagal ng data transmission.

Kasama sa panukala ang pagpapataw ng kaparusahang administratibo na may multang nagkakahalaga mula P100,000 hanggang P5 milyon sa araw-araw habang nagpapatuloy ang paglabag para sa kalahok sa industriya na mabibigong sumunod sa minimum service standards na itinakda ng NTC.

Kapag ang isang kalahok ay nakagawa ng ipinagbabawal, ang multa ay magkakahalaga ng P300,000 hanggang P5 milyon sa bawat araw ng paglabag. 

Ang pagpapatupad ng patakaran at alituntunin ay ipalalabas ng NTC.
