PANUKALANG MAGTAKDA NG MGA REGULASYON SA PAGPOPROSESO NG MAPANGANIB NA BASURA, PASADO NA SA KAMARA

Aprubado na sa ikatlo at pinal na pagbasa kagabi ng Kamara ang panukalang Waste Treatment Technology Act, na naglalayong isailalim sa regulasyon ang pagtatapon, paggagamot at pagpoproseso ng mga mapanganib na basura sa isang mapapakinabangang produkto.

Ang HB06444, na pinagsama-samang mga panukala, ay kasama ang isang bill na pangunahing iniakda ni Speaker Martin Romualdez.

Ipapawalang bisa ng panukala ang Section 20 ng RA08749 na mas kilala bilang Clean Air Act of 1999.

Sa naturang seksyon ay ipinagbawal dito ang pagsusunog ng mga mapanganib na basura at ang pag phaseout nang mga incinerator.

Sa hiling na pahintulotang sunugin ang mga basura, ang mga may-akda ng panukala ay nagsabing may mga nagsulputang bagong teknolohiya simula nang isinabatas ang RA 8749, tulad ng paggawa ng basura upang maging enerhiya.

“Waste-to-energy (WTE) or energy-from-waste is the process of generating energy in the form of electricity heat from the incineration of waste. WTE technologies that process non-renewable waste can reduce environmental and health damages, while generating sustainable energy,” anila.

Sinabi nila na ang pagwawalang bisa ng Section 20 sa Clean Air Act of 1999 ay magbibigay-daan para sa “modern options in solving the persistent garbage problem of our country and in the process attract more investors by providing fiscal and non-fiscal incentives.”

Ipapahintulot ng HB 6444 ang “thermal and other treatment technologies for the disposal of municipal and hazardous wastes, or for the processing of waste material for fuel, whether for commercial use or not.”

Kakailanganin ng mga naturang teknolohiya na mapagkasya sa kagamitan na patuloy na magmomonitor, magtatala, at magsasapubliko ng mga naitala at naiulat na mga datos sa kanilang emissions o air pollutant concentrations.

Ang mga panukalang waste-to-energy conversion ay bibigyan ng prayoridad kesa sa ibang pamamaraan ng paggagamot. Ang mga pasilidad ng thermal ang gagamot sa mga basura sa temperaturang hindi bababa sa 850 degrees centigrade.

Ang Department of Environment and Natural Resources (DENR) ang ahensyang magiging pangunahing responsable sa pagpapatupad ng panukalang batas, samantalang ang Department of Energy (DoE) naman ang mangangasiwa ng mga regulasyon sa mga pasilidad ng waste-to-energy.

Imamandato sa mga lokal na pamahalaan (LGUs) ang pagsusulong, paghihikayat at implementasyon ng isang programa sa komprehensibong solid waste management na kinabibilangan ng waste reduction, segregation, recycling, composting, at recovery.

Tutulong rin ang mga lokal na pamahalaan sa pagtatayo ng mga pasilidad sa treatment ng basura.

Ang iba pang mga may kaugnayang ahensya na isasama sa implementasyon ng panukalang Waste Treatment Technology Act ay ang Department of Science and Technology at ang National Solid Waste Management Commission.

Aatasan rin ng panukala ang mga government financial institutions tulad ng Land Bank at Development Bank of the Philippines na, “accord high priority in the extension of financial services to individuals, enterprises or private entities engaged in putting up treatment facilities.”

Pahihintulutan rin ang DoE na maggawad ng mga insentibo sa mga proyektong waste-to-energy.

Ang proseso sa pag-iisyu ng mga permiso at lisensya para sa mga pasilidad ng waste-to-energy ay susunod sa mga batas na ipinaiiral ng Energy Virtual One-Stop Shop Act at ng Ease of Doing Business and Efficient Government Service Delivery Act of 2018.

Ang DENR at ang DoE ang mag-iisyu ng mga patakaran at alintuntunin.
