LEGISLATIVE PROCESS

How A Bill Becomes A Law


1. PREPARATION OF THE BILL

The Member or the Bill Drafting Division of the Reference and Research Bureau prepares and drafts the bill upon the Member's request.


2. FIRST READING

  1. The bill is filed with the Bills and Index Service and the same is numbered and reproduced.
  2. Three days after its filing, the same is included in the Order of Business for First Reading.
  3. On First Reading, the Secretary General reads the title and number of the bill. The Speaker refers the bill to the appropriate Committee/s.


3. COMMITTEE CONSIDERATION/ACTION

  1. The Committee where the bill was referred to evaluates it to determine the necessity of conducting public hearings. 
    If the Committee finds it necessary to conduct public hearings, it schedules the time thereof, issues public notics and invites resource persons from the public and private sectors, the academe and experts on the proposed legislation. 
    If the Committee finds that no public hearing is not needed, it schedules the bill for Committee discussion/s.
  2. Based on the result of the public hearings or Committee discussions, the Committee may introduce amendments, consolidate bills on the same subject matter, or propose a subsitute bill. It then prepares the corresponding committee report.
  3. The Committee approves the Committee Report and formally transmits the same to the Plenary Affairs Bureau.

4. SECOND READING

  1. The Committee Report is registered and numbered by the Bills and Index Service. It is included in the Order of Business and referred to the Committee on Rules.
  2. The Committee on Rules schedules the bill for consideration on Second Reading.
  3. On Second Reading, the Secretary General reads the number, title and text of the bill and the following takes place:
    1. Period of Sponsorship and Debate
    2. Period of Amendments
    3. Voting which may be by:
      1. viva voce
      2. count by tellers
      3. division of the House; or
      4. nominal voting


5. THIRD READING

  1. The amendments, if any, are engrossed and printed copies of the bill are reproduced for Third Reading.
  2. The engrossed bill is included in the Calendar of Bills for Third Reading and copies of the same are distributed to all the Members three days before its Third Reading.
  3. On Third Reading, the Secretary General reads only the number and title of the bill.
  4. A roll call or nominal voting is called and a Member, if he desires, is given three minutes to explain his vote. No amendment on the bill is allowed at this stage.
    1. The bill is approved by an affirmative vote of a majority of the Members present.
    2. If the bill is disapproved, the same is transmitted to the Archives.


6. TRANSMITTAL OF THE APPROVED BILL TO THE SENATE

The approved bill is transmitted to the Senate for its concurrence.


7. SENATE ACTION ON APPROVED BILL OF THE HOUSE

The bill undergoes the same legislative process in the Senate.


8. CONFERENCE COMMITTEE

  1. A Conference Committee is constituted and is composed of Members from each House of Congress to settle, reconcile or thresh out differences or disagreements on any provision of the bill.
  2. The conferees are not limited to reconciling the differences in the bill but may introduce new provisions germane to the subject matter or may report out an entirely new bill on the subject.
  3. The Conference Committee prepares a report to be signed by all the conferees and the Chairman.
  4. The Conference Committee Report is submitted for consideration/approval of both Houses. No amendment is allowed.


9. TRANSMITTAL OF THE BILL TO THE PRESIDENT

Copies of the bill, signed by the Senate President and the Speaker of the House of Representatives and certified by both the Secretary of the Senate and the Secretary General of the House, are transmitted to the President.


10. PRESIDENTIAL ACTION ON THE BILL

  1. If the bill is approved the President, the same is assigned an RA number and transmitted to the House where it originated.
  2. If the bill is vetoed, the same, together with a message citing the reason for the veto, is transmitted to the House where the bill originated.


11. ACTION ON APPROVED BIL

The bill is reproduced and copies are sent to the Official Gasette Office for publication and distribution to the implementing agencies. It is then included in the annual compilation of Acts and Resolutions.


12. ACTION ON VETOED BILL

The message is included in the Order of Business. If the Congress decides to override the veto, the House and the Senate shall proceed separately to reconsider the bill or the vetoed items of the bill. If the bill or its vetoed items is passed by a vote of two-thirds of the Members of each House, such bill or items shall become a law.


NOTE: A joint resolution having the force and effect of a law goes through the same process.

Magpapatuloy ang Kamara sa pagtatrabaho sa mga natitirang prayoridad na lehislasyon, kahit na nakabakasyon ang Kongreso.


Ito ay matapos na pahintulutan ng liderato ng Kamara, sa pamumuno ni House Speaker Martin Romualdez noong Miyerkules ng gabi, ang lahat ng mga Komite na magdaos ng mga pagdinig kung kinakailangan, sa panahon ng bakasyon mula kahapon, ika-23 ng Marso hanggang ika-7 ng Mayo 2023, upang maproseso ang mga mahahalagang panukala na nakabinbin sa iba’t ibang lupon ng Kamara.


Ito ay sa pamamagitan ng pormal na mosyon sa plenaryo ng House Majority Leader nang hiniling niya na lahat ng mga Komite at Special Committees ay magdaos ng mga pagpupulong kahit nasat Lente Recess ang Lehislatura.


Bago idineklara ang bakasyon, inanunsyo ni Speaker Romualdez ang tagumpay na pagpasa sa ikatlo at huling pagbasa ng 23 sa 31 panukalang tinukoy ng Legislative-Executive Development Advisory Council (LEDAC) bilang mga prayoridad na lehislasyon ng administrasyon ni Pangulong President Ferdinand R. Marcos, Jr.   


Ang mga panukalang ito ay naipadala na sa Senado para sa kaukulang aksiyon naturang Kapulungan.

Ipinagmalaki din ni Speaker ang mga nagawa ng Kamara sa loob ng 9 na buwan ng 19th Congress na di pa aniya nagagawa kailanman.


Ayon sa lider ng Kamara, isang mahalagang usapin ang pagkakadawit ni Negros Oriental Cong. Arnie Teves sa pagpaslang kay Gov. Roel Degamo at ilan pang indibidwal, na nangangailangan ng madalian at maayos na aksiyon ng Kapulungan.


Dumaan ani Romualdez sa tamang proseso ang pagdinig ng Committee on Ethics and Privileges at iginalang ang mga karapatan ni Rep. Teves bago ito nagsumite ng report para sa agarang plenary action.


Matatandaan na sa botong 292, pinatawan ng Kamara ng 60 days suspension si dahil sa hindi tamang pag-uugali o disorderly behavior.

Nagmosyon si Quezon Rep. David Suarez na i-contempt ang dalawa dahil sa umano'y non-cooperation at hindi sumasagot ng totoo sa pagdinig at sinag-ayunan naman ng mga miyembro sa botohan na ang resulta ay unanimous o 20 na pabor sa pag-contempt kina Ong at Ang.


Sinabi ni Quezon Rep. Mark Enverga, chairman ng komite, na ang dalawa ay madidetine sa loob ng 10 araw sa loob ng pasilidad ng Batasan Pambansa complex.

IMBESTIGASYON SA PAG-RECYCLE NG DROGA AT SISTEMA NG PABUYA, IPINAGPATULOY


Ipinagpatuloy ng House Committee on Dangerous Drugs na pinamunuan ni Surigao de Norte Rep Robert Ace Barbers ang kanilang motu proprio investigation sa diumano'y pag-recycle, sistema ng pabuya, at ang umano’y komisyon na natatanggap ng mga impormante, o non-organic intelligence na tauhan ng Philippine Drug Enforcement Agency (PDEA). 


Sinabi ni Rep. Barbers na ang nasabing pamamaraan, gaya ng inihayag ni PDEA Director General Moro Virgilio Lazo ay isang indikasyon na ang ating law enforcement agencies ay may mga unscrupulous na mga empleyado na patuloy pa ring ibinibenta ang kinabukasan ng ating mga kabataan at ng ating lipunan para lamang sa kanilang personal na kapakinabangan 


Ayon sa kanya, these people are a menace to our society, at idinagdag pa niya na ang mga taong ito ay mas masahol pa … sa mga drug dealers na hinuhuli. Nagmumukhang ligal at government sponsored ang ating mga drug deals. Kaya pala hindi matapos tapos at maubos ubos ang iligal na droga sa ating kalsada.


Binigyang-diin ni Director General Lazo na walang polisiya ang PDEA na nagbibigay ng 30 porsiyento ng mga nakumpiskang iligal na droga sa mga impormante bilang pabuya. 


Nilinaw niya na ang kaniyang isiniwalat sa publiko na may mga fixer na naghahanap ng mga nakumpiskang droga bilang pabuya ay isinagawa nang walang masamang hangarin. 


Pinuri naman ni Rep. Barbers si PDEA Director General Lazo sa pagharap at tiniyak nito sa kaniya ang "lahat ng suporta at proteksyon kung kinakailangan sa pagsisiwalat ng katotohanan upang iligtas ang ating bansa" ng Komite. 


PANUKALANG LILIKHA NG MGA KONSEHO LABAN SA DROGA, INAPRUBAHAN NG KOMITE, IPRUBADO NA SA KOMITE NG KAMARA


Inaprubahan ng Komite ng Dangerous Drugs sa Kamara, na pinamumunuan ni Surigao del Norte Rep. Robert Ace Barbers, ang panukalang lilikha ng mga anti-drug abuse council (ADACs) sa lahat ng mga lalawigan, lungsod, munisipalidad, at barangay sa buong bansa. 


Ang mga panukalang batas ay iniakda ni Rep. Barbers at iba pang mga solon.


Sa deliberasyon ng komite, iminungkahi ni Batanes Rep. Ciriaco Gato Jr. na isama ang kinatawan ng distrito ng lungsod o lalawigan bilang permanenteng ex-officio na kasapi ng ADAC. 


Ipinunto naman ni Leyte Rep. Richard Gomez na hindi lahat ng mga mambabatas ay nakikipag-ugnayan sa mga alkalde ng lungsod.


PAG-AALIS NG CANNABIS SA LISTAHAN NG MAPANGANIB NA SANGKAP NA NAKAPALOOB SA HB 6783, TINALAKAY NG TWG


Nagpulong kahapon (ngayong Huwebes) ang technical working group (TWG) ng Komite ng Dangerous Drugs sa Kapulungan ng mga Kinatawan, na pinamumunuan ni Surigao del Norte Rep. Robert Ace Barbers, upang talakayin ang House Bill 6783 na naglalayong alisin ang cannabis at anumang anyo nito o deribatibo sa listahan ng mga mapanganib na droga at mga sangkap sa ilalim ng mga umiiral na batas. 


Aamyendahan ng panukalang batas na iniakda ni Davao del Norte Rep. Pantaleon Alvarez ang Republic Act 9165, na kilala bilang Comprehensive Dangerous Drugs Act of 2002, na naamyendahan na. 


Nakasaad sa panukalang batas ang pag-aalis ng “cannabis and cannabis resin and extracts and tinctures of cannabis from said list and schedules.”  


Tinunton ng Vice Chair ng Komite ng Dangerous Drugs at Leyte Rep. Richard Gomez, na pinamunuan din ang TWG, ang kasaysayan ng paggamit ng cannabis sa United States of America at sa buong mundo. 


Ipinabatid ni Rep. Gomez sa mga resource speaker na susubukan ng TWG na balansehin ang lahat sa talakayan ng panukalang batas upang payagan ang paggamit ng cannabis o mga deribatibo nito para sa ilang partikular na gamit. 


Gumawa siya ng eksepsiyon para sa paggamit sa paglilibang ng cannabis "hanggang matapos ang opisyal, konklusibo at siyentipikong pag-aaral ay makumpleto ng mga Pilipinong siyentipiko at eksperto na nasa serbisyo ng pamahalaan."  


Ipinarating naman ng chief of staff ni Rep. Alvarez na si Atty. Vincent Aureus, ang posisyon ng kaniyang amo sa panukalang batas, “Ang position ni Congressman Alvarez is that sayang yung revenue potential ng marijuana. If we wait for the entire world to legalize it, tapos saka pa lang tayo mag legalize, by that time, the price of marijuana also follows the law of supply and demand. So wala na tayong makukuha by that time. Pag dating sa concerns regarding health, we recognize may concern ang Philippine Medical Association (PMA) but at the same time if we allow substances with no clear benefits pagdating sa health, such as alcohol and cigarettes, then it does not make sense anymore. It does not add up na we will prohibit marijuana.”  


Binanggit ni Atty. Ferdausi Masnar, kumakatawan sa Dangerous Drugs Board, bukod sa iba pa, na ang Pilipinas ay lumagda sa 1961 Single Convention on Narcotic Drugs, na sinusugan ng 1972 Protocol. Sinabi ni Masnar na bahagi ng pangkalahatang obligasyon ng Estado sa kumbensyong iyon ay bigyan ng bisa at maisakatuparan ang mga probisyon ng kombensiyon sa bansa.  


Ipinahayag naman ng kinatawan ng Food and Drug Administration na si Atty. Emilio Polig Jr., na sa ilalim ng kanilang umiiral na mga panuntunan at regulasyon, ang paggamit ng cannabis ay pinapayagan lamang sa konteksto ng medikal na paggamit.  


Nagpahayag ng suporta ang Commission on Human Rights (CHR) sa panukalang batas. Inirerekomenda ni Atty. Joms Asalan ng CHR ang pagsama ng isang probisyon ng regulasyon sa panukalang batas. 


Ang iba pang mga ahensya at organisasyon na nagsumite ng mga komento at posisyon sa panukalang batas ay ang Department of Health (DOH), National Bureau of Investigation (NBI), Philippine Drug Enforcement Agency (PDEA), Philippine National Police (PNP), Department of Justice (DOJ), PMA, at ang Medical Cannabis Party-list.


PANUKALANG PHILIPPINE NATIONAL NUCLEAR ENERGY SAFETY ACT, INAPRUBAHAN NG ESPESYAL NA KOMITE

 

Inaprubahan ngayong Miyerkules ng Espesyal na Komite ng Enerhiyang Nukleyar sa Kapulungan ng mga Kinatawan, na pinamumunuan ni Pangasinan Rep. Mark Cojuangco, ang wala pang bilang na Substitute Bill sa House Bill 7049, mula sa pinagsama-samang mga HBs 371, 481, 526, 542, 1255, 2103, 3301, 3898, 4822, 6030, 7003 at 7330, na nagtatatag sa Philippine Atomic Energy Regulatory Authority. 


Nakasaad din sa panukalang batas para sa isang komprehensibong ligal na balangkas para sa proteksyon mula sa radyasyon, at seguridad sa nukleyar at mga pag-iingat, gayundin ang kaligtasan sa mapayapang paggamit ng enerhiyang nukleyar sa Pilipinas, at paglalaan ng mga pondo para dito. 


Nakakuha ang substitute bill ng 16 na pabor na boto, at walang kontra na boto mula sa mga kasapi ng Komite na dumalo sa pagpupulong. 


Kabilang sa mga layunin ng panukalang batas ay ang: 1) pagtatag ng Philippine Atomic Energy Regulatory Authority o PhilATOM na may mga tungkulin at responsibilidad na nakasaad sa Batas; 2) pagtatatag ng ligal na balangkas na ipapatupad ng Philippine Atomic Regulatory Authority, kabilang ang pagpapalabas ng mga regulasyon, pamahalaan at padaliin ang mapayapa, ligtas at siguradong paggamit ng enerhiyang nukleyar; at 3) protektahan ang mga tao at ang kapaligiran ngayon at sa hinaharap laban sa mga mapaminsalang epekto ng ionizing radiation. 


Sa ilalim ng panukalang batas, magiging isang independiyenteng awtoridad ang PhilATOM. 


Magkakaroon ito ng solo at eksklusibong hurisdiksyon na magsagawa ng kontrol sa regulasyon para sa mapayapa, ligtas at siguradong paggamit ng enerhiyang nukleyar at mga pinagmumulan ng radyasyon sa bansa. 


Lahat ng tungkulin sa regulasyon ng Philippine Nuclear Research Institute ay ililipat sa PhilATOM.  


Bago inaprubahan ng Komite ang panukalang batas, binanggit ni Rep. Cojuangco ang iminungkahing susog ni Kabataan Rep. Raoul Manuel sa Seksyon 10, na may kaugnayan sa kalinawan at proteksyon ng impormasyon sa paggamit ng enerhiyang nukleyar. 


Iminungkahi ni Rep. Manuel na “all information pertaining to risks involving the nuclear facilities and incidents and abnormal occurrences that could have an impact on public health, safety and the environment must be made public in a timely and accessible manner.” 


Nagmosyon si Rep. Cojuangco na dapat panatilihin ng Komite kung ano na ang nakasaad sa Seksyon 10, talata b, na nagsasabi na lubhang nakakabahala ang mga terminong “risks… and abnormal occurrences” na iminungkahi ni Rep. Manuel. 


Ang mosyon na ito ni Rep. Cojuangco ay pinagtibay ng Komite. Itinuring ni Rep. Cojuangco ang pag-apruba ng Komite sa panukala na “isang dahilan para magdiwang. 


“Now we have the bill passed by the committee and hopefully, it will be carried also on the floor on second and third reading.” 


Pinuri ni Philippine Ambassador to Vienna Peachy Natividad ang Komite “for this excellent work that you have done, the painstaking hours of discussions and deliberations to push forward our nuclear law that would definitely benefit our people and future generations.” 


Tiniyak niya sa Komite na buo ang suporta ng International Atomic Energy Agency IAEA sa panukala. 


Sinabi niya na malugod na umaasa ang direktor heneral ng IAEA sa kaniyang pagbisita sa Pilipinas ngayong Mayo upang palakasin at palawigin ang anumang suporta na maitutulong ng ahensya sa gawaing itinutulak ng Kongreso.  


Pinagtibay din ng Komite ang House Resolution 853 na inihain nina APEC Rep. Sergio Dagooc at PHILRECA Rep. Presley de Jesus, na humihimok sa Kagawaran ng Enerhiya na isaalang-alang, makipag-ugnayan at pumasok sa mga intergovernmental na kasunduan para sa pagtatatag at pagpapatakbo ng mga pasilidad na pagkukunan ng kuryente mula sa enerhiyang nukleyar sa Pilipinas.


MGA AKLAT NG DIGITAL COMPENDIUM OF LAWS, EXECUTIVE ISSUANCES, AT JURISPRUDENCE ON WATER RESOURCES, INILUNSAD NG KAPULUNGAN


Inilunsad ngayong Miyerkules ng Kapulungan ng mga Kinatawan ang pinakahuli nilang ipinalimbag na aklat na may titulong “Laws, Executive Issuances and Jurisprudence on Water Resources (1901-2022),” na magsisilbing reference tool para sa mga polisiyang pananaliksik sa tubig. 


Sa mensahe ni Rep. Yedda Marie Romualdez, na binasa ni Special Committee on Strategic Intelligence at Davao de Oro Rep. Maria Carmen Zamora, na ang paglulunsad ng naturang aklat ay, “a crucial step towards fully implementing our laws and allowing our people to take part in our efforts for the preservation of our country’s water resources. It is our hope that this collaboration spearheaded by the LIRMD and LAD will open up more discussions and interests in the topic and therefore promote public participation.” 


Si Rep. Romualdez ang pangunahing may-akda ng House Bill 21, na nagmumungkahi ng “National Framework for Water Resource Management and Creating the Department of Water Resources and the Water Regulatory Commission”, kabilang sina Speaker Ferdinand Martin Romualdez at Tingog Party-list Rep. Jude Acidre. 


Nagpahayag ng pagtitiwala si House Secretary General Reginald Velasco na ang compendium of “Laws, Executive Issuances and Jurisprudence on Water Resources” ay magiging napakahalagang mapagkukunan ng marami, ng abang ambag sa e-governance, at sa testament kung papaano nakakapamahagi ang House of the People ng komprehensibo, makabago at mga serbisyong may pananagutan sa kalikasan. 


Ipinaliwanag ni Legislative Information Resource Management Department (LIRMD) Deputy Secretary General (DSG) Dr. Edgardo Pangilinan, Ph.D., na ang compendium ay dinisenyo upang bigyan ang mga mambabatas, gayundin ang mga nagpapatupad ng mga polisiya, analysts, scholars, mga nagsusulong sa pribadong sektor, at publiko ng mas komprehensibong mga materyal na maaaring maging reference sa iba’t ibang aspeto ng pamamahala. 


“The compendium illustrates the strength of collaboration in raising the quality of public services,” ani DSG Pangilinan. 


Ang compendium ay pinagsama-samang pagsisikap ng LIRMD at ng Legal Affairs Department (LAD). Ayon kay LAD DSG Atty. Annalou Nachura, ang espesyal na pakikipagtulungan sa pagitan ng LIRMD at LAD ay nakapagpaunlad ng mga kakayahan, talent at mga kagustuhan ng kanilang mga tauhan na gumawa ng pangunahing digital interactive publication. 


Ibinahgi ni DSG Pangilinan ang compendia of laws, executive issuances at jurisprudence on disaster management and education, na kabilang rin sa mga pangunahing proyekto ng LIRMD. 


Makikipagtulungan rin ang LIRMD sa Committee Affairs Department at sa Legislative Operations Department para sa mga naturang proyekto.
